Terms of Service

 

These Terms of Service explain your rights and obligations in using our website and apps. Permission to use the apps and services is conditional upon you agreeing to the terms set out in this document. The services are offered to you on condition that you read and accept this document and agree to be bound by its terms.

We refer to our website visitors and application users as "Users" or "you" in the further text and we, Lux Live Wallpapers, as a developer and publisher of apps and games, may be referred as "App Developer", "Service Provider", "we", "us" or "our", as the context requires.

Terms of Service are not regulated by law and introducing the act is not required by any regulations, so that a service provider makes a contract of their own will. It means service providers create terms of service of their products on their own (respecting only imperative norms which protect public order, public interest and morals, and total third party`s rights).

By installing, using or accessing the apps and services you are considered to have accepted the terms set out in this document. If you do not agree with or otherwise wish to accept the terms set out in this document, do not install, use or access the apps.

THE TERMS THE USER MUST ACCEPT
 

In order to be able to download and use the application, the user acknowledges and agrees that the app has access to:
 

• Phone – the app reads phone status and identity

• Photos/ Media/ Files – the app reads the contents of USB storage and modifies or deletes the contents of USB storage

• Storage – the app reads the contents of USB storage and modifies or deletes the contents of USB storage

• Device ID & call information – the app reads phone status and identity

   

The app may also:

​

• receive data from the Internet

• view network connections

• full network access

• run at startup

• set wallpaper

• prevent the device from sleeping

• modify system settings

   

APP DEVELOPER`S RIGHTS
 

App Developer has the full right to deny the provision of services to the User who does not agree on the terms of use and not to allow data processing, after providing the user with both Terms and Conditions and Privacy Policy and enabling the user to previously get to know their content.

According to the protection of intellectual property rights, products represent the service provider`s copyright works, especially a text, design, software, code.

The service provider has the right to temporarily deny the provision of services to the user during maintaining the products and fixing the errors.

When selling the product and its items, the app developer has the right to charge the particular elements in the application in accordance with the law which regulates traffic of services and goods.

Lux Live Wallpapers may permanently stop providing service in case it makes the decision the product is unprofitable anymore, if issues cannot be fixed, or if the application stops working due to the reasons the service provider cannot have an influence on.
 

APP DEVELOPER`S OBLIGATIONS:
 

Users have to be given technical support during the period of using the product. App Developer needs to keep maintaining the products to be technically correct and to clearly and unambiguously notify users of the product price, provide payment instructions as well as conditions and procedure of refund.

In case the user has withdrawn consent for personal data processing and consent for terms of use, App Developer is required to delete the data as soon as possible.

USER`S RIGHTS:

​

The user has to be clearly notified of terms of use, rights, and obligations prior to giving their consent. The user has the full right of personal data protection, as well as the right of technical support.

Withdrawing consent on data processing and terms of use is possible anytime.

USER`S OBLIGATIONS:

​

The user is obliged to use products only for private purposes, as well as to respect intellectual property rights of the service provider.

In case of sharing their own content publicly, users have to respect other people`s rights: the inviolability of personal data, intellectual property rights, the right to religious, sexual and political belief, ethnicity, public order and morals in general, forbidden spamming.

Pecuniary damage arisen due to unauthorized use of rights, which represents the service provider`s intellectual property, needs to be compensated by the user.

INTELLECTUAL PROPERTY RIGHTS:
 

The application as a multimedia work in whole is a copyrighted work of the app developer Little Quail and it is protected by both domestic and international regulations of copyright protection and related rights. The product elements such as text, drawings, design, code are as well individually protected as copyright works of the service provider.
 

THE RIGHTS OF SHARING AND PUBLISHING USERS` CONTENT IN THE APPLICATION
 

Users have the right to leave comments and share their content publicly on a discussion panel. The service provider recommends users not to leave or to leave as little personal data as possible on public discussions and open panels available to the other users. The user who has voluntarily and freely left their personal data has agreed on their processing.
 

PRODUCT SALES

If users purchase products or services through the service provider`s apps and games, they are required to provide billing information (name, billing address, credit card information). Users have to check carefully if all billing information is complete and accurate.

App Developer may offer the user to purchase an ad-free in-app, or in-app containing special content or features. The purchasing process is completed directly from within the app.
 

MAINTENANCE AND DEBUGGING

​

The service provider is required to keep regular maintenance of the products such as apps and games.

With the appearance of any bugs in apps, the service provider has to remove all faults as soon as possible, depending on the issue.

If users come up to or find any errors within the apps, they may report to the technical support team at luxlivewallpapers@gmail.com.
 

ADVERTISING
 

The user acknowledges and agrees that:

• the services may feature advertisements from the App Developer and/or third parties;

• the App Developer may at its sole discretion introduce advertising into applications or services that do not presently contain advertising;

• the App Developer is not responsible for the content of any third party advertisements, nor the content of any website or other materials that may be linked to by third party advertisements, and you view such third party websites and materials at your sole risk;

• the provision of information to third party advertisers by the App Developer is permitted and governed by the App Developer’s Privacy Policy.

WITHDRAWAL OF USER CONSENT

​

The user sends a notice of withdrawal of consent with Terms of Service to the email address: luxlivewallpapers@gmail.com. The service provider is required to delete the data in the short term.

By deactivating the product from the device, the user simultaneously withdraws the consent with the terms of use of the product.
